1. Agreement to Terms

By accessing or using LaunchX (“the Service”), operated at launchx.ca, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.

2. Description of Service

LaunchX provides managed web application hosting, including server provisioning, ongoing maintenance, security monitoring, performance optimization, and technical support. Our services are delivered through a customer portal where you can manage your sites, submit support tickets, and view billing information.

3. Account Terms

To use LaunchX, you must create an account with accurate and complete information. You are responsible for:

• Maintaining the security of your account credentials, including your password.
• All activity that occurs under your account, whether or not you authorized it.
• Notifying us immediately at [email protected] if you suspect unauthorized access to your account.

Each account is intended for use by a single individual or organization. Sharing account credentials with multiple parties is not permitted.

4. Payment and Billing

LaunchX offers subscription-based pricing with multiple plan tiers. All payments are processed securely through Stripe. By subscribing to a plan, you authorize us to charge your payment method on a recurring basis.

• Billing cycle: Subscriptions are billed every 4 weeks unless otherwise specified.
• Cancellation: You may cancel your subscription at any time. Access to the Service will continue through the end of your current billing period.
• Refunds: We do not offer refunds for partial billing periods. If you believe a charge was made in error, please contact us promptly.
• Plan changes: To upgrade, downgrade, or modify your plan, please contact our team directly.

5. Service Level

We target 99.9% uptime for all hosted services. While we make every reasonable effort to maintain availability, scheduled maintenance windows may occur. We will provide advance notice of planned maintenance whenever possible.

Downtime caused by factors beyond our control, including third-party service outages, natural disasters, or force majeure events, is not included in our uptime calculations.

6. Acceptable Use

You agree not to use LaunchX for any purpose that is unlawful or prohibited by these terms. Specifically, you must not:

• Host, distribute, or link to illegal content, malware, or phishing sites.
• Abuse server resources in a manner that degrades performance for other customers.
• Attempt to gain unauthorized access to our systems, other accounts, or related networks.
• Use the Service to send unsolicited bulk email (spam) or engage in abusive communication.

Violation of these terms may result in immediate suspension or termination of your account without notice.

7. Intellectual Property

Your content: You retain full ownership of all content, data, and materials you upload to or create on LaunchX. We do not claim any intellectual property rights over your content.

Our platform: The LaunchX platform, including its design, code, features, branding, and documentation, is the intellectual property of LaunchX. You may not copy, modify, distribute, or reverse-engineer any part of the platform.

8. Limitation of Liability

To the maximum extent permitted by law, LaunchX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you have paid to LaunchX in the twelve (12) months preceding the claim.

9. Termination

Either party may terminate the service relationship at any time:

• By you: Cancel your subscription through the portal or by contacting us. Your access continues through the end of the billing period.
• By us: We may suspend or terminate your account for violation of these terms, non-payment, or at our discretion with reasonable notice.

Upon termination, you may request an export of your data. We will make your content available for download for a reasonable period (typically 30 days) following account closure.
